June 21, 2021 by Fillmore County Journal

The following is a summary of the above-mentioned Ordinance for Solid Fuel-Fired Heating Devices, approved by the Whalan City Council, the full version of which is available for inspection by any persons during regular office hours at the office of the City Clerk at the Whalan City Hall,

To summarize, this ordinance:

Was created for the health, fire safety, and welfare of the Citizens. This Ordinance imposes reasonable restrictions on the use, installation, and operation of Solid Fuel-Fired Heating Devices within the City of Whalan. This chapter also deals with prohibitions, regulations, and repairs regarding the Solid Fuel-Fired Heating Devices.

This ordinance makes certain existing Solid Fuel-Fired Heating Devices nonconforming if they don’t meet EPA or New Source Performance Standards criteria, and prohibits their extension, enlargement, or expansion. Contrarily, this ordinance also identifies requirements for new and existing Solid Fuel-Fired Heating Devices.

The ordinance concludes with requirements necessary to apply for a new Solid Fuel-Fired Heating Device, as well as enforcement and penalty provisions for any non-compliant Solid Fuel-Fired Heating Device.
