HEARING ON PETITION BY
INTERESTED PERSONS TO INVOKE
COURT’S IN REM JURISDICTION
FOR ACCOUNTING PURSUANT TO
MINN. STAT. SEC. 501C.0201 ET SEQ
AND 501C.0813
PLEASE TAKE NOTICE that Petitioners have filed a Petition by Interested Persons to Invoke Court’s In Rem Jurisdiction for Accounting Pursuant to Minn. Stat. Sec. 501C.0201 et seq.
The Petition requests the following relief:
- To determine the persons having an interest in the income or principal of the various trusts and the nature and extent of their interests;
- To require David P. Jack to provide accountings pursuant to Minnesota General Rule of Practice 417.02; and
- Granting such other relief as may be proper.
The Court represents [or has appointed a representative to represent] all persons in interest who are minors or incapacitated, or unborn, unascertained or whose identity or address is unknowns and not reasonably ascertainable, and has determined that all other persons with an interest in the Trusts are represented under section 501C.0301 to 501C.0304.
IT IS ORDERED that, on April 23, 2026, at 2:00 PM, a remote hearing will be held at the Fillmore County Courthouse, 101 Fillmore Street W., Preston, MN 55965, via
electronic means, on the Petition. See remote hearing notice. Specifically, Petitioners are requesting that the Court take action pursuant to Minnesota Statutes Sections 501C.0202(3), (8), and (24).
Any objections to the Petition must be raised at the hearing or filed with the Court prior to the hearing. If the Petition is proper and no objections are filed or raised, the Petition will be granted.
Notice shall be given to all current trustees and qualified beneficiaries of the trust whose identity is known and whose location is known or reasonably ascertainable to the petitioners after making reasonable efforts to locate such persons. Notice shall be given (1) by mailing a copy of this Notice and Order by U.S. Postal Service at least 15 days prior to the hearing date; and (2) by publishing this Notice and Order at least 20 days before the date of the hearing, a copy of this Order for hearing one time in a legal newspaper for Fillmore County.
