PREBLE TOWNSHIP FILLMORE COUNTY, MINNESOTA Ordinance Number 2026-01 AN ORDINANCE AMENDING  ANIMAL FEEDLOT ZONING REGULATIONS The Board of Supervisors of the Town of Preble ordains:

Section 1. Legislative Findings. The Town Board of Preble Township (“Town”) hereby finds as follows. 

  1. Section 7(C) of Ordinance 2019-02 adopted on the 30th day of September 2019, prohibiting construction of new residences within 2,640 feet (1/2 a mile) of existing feedlots, is unduly restrictive of the construction of new residences in the Town. 
  2. The Town draws a distinction between property owners knowingly choosing to build a residence close to an existing feedlot and the opposite scenario—a feedlot being established close to a pre-existing residence. In the former scenario, the residential property owner building a residence is willingly choosing to accept the possible negative odors, dust, flies, noise, and additional traffic. In the latter scenario, the residential property owner is not choosing to accept those negatives. 
  3. Property owners desiring to build a new residence within the Town can be trusted to personally weigh the pros and cons of building within 2,640 feet of a feedlot without the Town deciding for them by means of a blanket prohibition. 
  4. The reasons for restricting feedlots from locating or expanding within 2,640 feet of a residence as originally presented in the ordinance remain relevant. 
  5. County zoning rules regulate residential housing density, which itself is already restraint on excessive residential development in rural townships, like Preble. 
  6. The interests between agricultural operations and landowners desiring to construct a new home will be better balanced because of this change. 

Section 2. Amendment. The Town Board amends ordinance 2019-02 by striking and removing Section 7(C) in its entirety. All other provisions of the ordinance shall remain in effect. 

Section 3. Effective Date. This Amendment shall take effect and be in full force on the first day of publication after its passage.
