The following is the official summary of Ordinance No.21, which was passed by the city Council of Rushford Village on July 1, 2025.
A printed copy of this ordinance is available for inspection by any person at the office of the city clerk during normal business hours, and at the community library, if there is one, or if not, in any other public location which the council designates.
The ordinance authorizing and regulating the conduct of lawful gambling within this City contains the following provisions.
Section 1 adopts Minn. Stat. Ch. 349, as it may be amended from time to time, by reference.
Section 2 permits the city to be more restrictive than state law concerning additional restrictions on gambling.
Section 3 provides a purpose statement of the Ordinance, which regulates lawful gambling.
Section 4 defines “Board”, “City”, “Council”, “Licensed Organization”, “Local Permit”, and “Trade Area” as those terms are used throughout the Ordinance.
Section 5 provides an applicability statement regulating all forms of lawful gambling with limited exceptions.
Section 6 allows for lawful gambling within the City so long as conducted in accordance with Minnesota State law and this Ordinance.
Section 7 requires Council approval for lawful gambling in accordance with State law and this Ordinance.
Section 8 establishes the procedures and criteria for obtaining a premises permit, and reasons a premises permit may be denied.
Section 9 establishes the procedures and criteria for obtaining a local permit, and reasons a local permit may be denied.
Section 10 allows for revocation and suspension of a local permit.
Section 11 provides that all permits issued under state law or this Ordinance shall be prominently displayed during the permit year where gambling is being conducted.
Section 12 provides that permit holders shall notify the City in \vriting of any material changes regarding information submitted with their application.
Section 13 establishes contributions of net profits to a special fund administered by the City.
Section 14 establishes a Designated Trade Area, as defined in the Ordinance, and requires organizations licensed to conduct gambling within the City to expend 100% of its lawful purpose expenditures on lawful purposes conducted within the City’s trade area.
Section 15 establishes records and reporting requirements from organizations to the City.
Section 16 establishes hours of operation for lawful gambling which shall not be conducted between 1 a.m. and 8 a.m. on any day of the week.
Section 17 provides penalties for violation of this Ordinance.
Section 18 includes a severability provision meaning if one provision of the Ordinance is found to be invalid, the validity of the remaining provisions shall not be affected.
Section 19 establishes the effective date of the Ordinance which is the date of the publication of this summary of the ordinance.
