NOTICE OF FORECLOSURE SALE

The right to verification of the debt and identity of the original mortgage creditor within the time provided by law is not affected by this action.

NOTICE IS HEREBY GIVEN, that default has occurred in the conditions of the following described judgment:

Date of Mortgage:  January 21, 2021

Original Principal Amount of Mortgage:  $68,000.00

Debtor:  Tracy L. Peterson, a single person

Mortgage Creditor:  ESB Bank

Date and Place of Recording:  Recorded February 1, 2021, with the Houston County Recorder, Houston County Courthouse, Caledonia, Minnesota 55921, as Document No. A301465.

Legal Description:

Lots 8 and 9 of Mons Fladager’s Addition to the City (formerly Village) of Spring Grove, the same being also known as the Original Plat to the City (formerly Village) of Spring Grove, according to the map or plat thereof on file and of record in the Office of the County Recorder (formerly Register of Deeds) in and for the County of Houston and State of Minnesota;

Also a tract of land described as commencing at the Southeast Corner of Lot 79 of Mons Fladager’s Second Addition to the City (formerly Village) of Spring Grove according to the map or plat thereof on file and of record in the office of the County Recorder in and for the County of Houston and State of Minnesota, running thence south to a line between Lots 7 and 8 of said Mons Fladager’s Addition to the City of Spring Grove, the same being also known as the Original Plat to the City of Spring Grove, said line being extended West, thence West 30 feet, thence North to the South line of said Lot 79, thence Easterly 30 feet to the point of beginning.

Also a tract of land described as commencing at the Southeast Corner of Lot 78 of said Mons Fladager’s Second Addition, running thence South 45 feet, thence West 50 feet, thence North 39.5 feet to the Southwest Corner of said Lot 78, thence Easterly along the South line of said Lot 78 to the place of beginning;

Also the South 41 feet of said Lot 78 and the East 30 feet of said Lot 79 except the North 67 feet of the said East 30 feet of said Lot 79 being a tract of land described as commencing  at a point on the East line of said Lot 78, 41 feet North of the Southeast Corner of said Lot 78 running thence West 80 feet to a point 20 feet East of the West line of said Lot 79 and 67 feet South of the North line of said Lot 79, thence South to the South line of said Lot 79, thence Northeasterly along the South line of said Lots 79 and 78 to the point of beginning.

Property Address:  206 S. Division Ave., Spring Grove, MN 55974

Tax Identification Numbers: 26.0006.000 & 26.0112.000

Amount due and claimed to be due as of date of Notice:  $67,843.85, as of August 13, 2024, along with statutory costs.

That all pre-foreclosure requirements have been complied with; that no separate action or proceeding has been instituted at law or otherwise to recover the debt secured by said mortgage, of any part thereof;

PURSUANT, to the power of sale contained in said mortgage, the above-described property will be sold by the Houston County Sheriff as follows:

Date and Time of Sale:  November 6, 2024 at 10:00 a.m.

Place of Sale:  Houston County Justice Center, front entrance, 306 S. Marshall St., Caledonia, Minnesota to pay the debt secured by said mortgage and taxes, if any, on said premises and the costs and disbursements, including attorneys fees allowed by law, subject to redemption within SIX MONTHS from the date of said sale by the debtor, his personal representative or assigns.

If the property is not redeemed, the debtor must vacate the property on or before 11:59 p.m. on May 7, 2025, or the next business day if May 7, 2025 falls on a Saturday, Sunday or legal holiday.

Debtor(s) released from financial obligation: NONE

“THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE DEBTOR, THE DEBTOR’S PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES SECTION 582.032 DETERMINING, AMONG OTHER THINGS, THAT THE PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAT 5 UNITS, ARE NOT PROPERTY USED FOR AGRICULTURAL PRODUCTION, AND ARE ABANDONED.”
