On July 25, Brently Steven Johnson, 61, of Winona, appeared before District Court Judge Jeremy Clinefelter. Johnson is charged with three felonies; Financial Transaction Card Fraud – Use – No Consent, Receiving Stolen Property – Motor Vehicle, and Receiving Stolen Property – Value Greater Than $1000. All three offenses each carry maximum criminal penalties of five years imprisonment and/or $10,000 fines. On or about July 23, in Rushford, the defendant allegedly stole a financial transaction card and then used it to purchase goods at a local convenience store. It was also revealed that the vehicle the defendant was allegedly driving had been reported stolen. The defendant is on parole and has multiple other convictions for Theft, Check Forgery, and Financial Transaction Card Fraud.
On July 31, Christopher Michael Anderson, 39, of Preston, appeared before District Court Judge Jeremy Clinefelter. Anderson in charged with Domestic Assault – By Strangulation, a felony with a maximum criminal penalty of three years imprisonment and/or a $5,000 fine. On or about July 29, a Fillmore County Sheriff’s Sergeant was dispatched to a domestic situation in rural Preston. A victim alleged that the defendant hit her and choked her. The victim allegedly had redness on the left side of her neck and upper chest just under her neck. The defendant’s blood alcohol level was later allegedly tested at .248.
On August 6, Dennis A. Hershberger, 49, of Preston, appeared before District Court Judge Jeremy Clinefelter. Hershberger is charged with Fleeing a Police Officer in a Motor Vehicle, a felony with a maximum criminal penalty of three years imprisonment and/or a $5,000 fine. On or about August 8, a Fillmore County Sheriff’s Deputy observed a vehicle travelling south on highway 52 at a high rate of speed. The deputy knew the driver to be Hershberger, and as he swung around to pursue for a Cancelled Driver’s License Inimical to Public Safety, the defendant allegedly accelerated away at a high rate of speed. He allegedly did not stop for lights and siren, with speeds reaching over 100 miles per hour for a short distance. The defendant later stopped and was apprehended.
On August 6, Brian Wayne Nelson, 50, of Harmony, appeared before District Court Judge Jeremy Clinefelter. Hanson is charged with two counts of Criminal Vehicular Homicide, Operate Vehicle With Negligence – Under Influence of Alcohol, and Operate Motor Vehicle with Alcohol Concentration .08 or More. He also charged with two counts of Criminal Vehicular Operation, Great Bodily Harm – Under Influence Alcohol, and Great Bodily Harm – Alcohol Concentration 0.08 or More. The two Criminal Vehicular Homicide counts each carry maximum criminal penalties of 10 years imprisonment and/or $20,000 fines. The two Criminal Vehicular Operation counts each carry maximum criminal penalties of five years imprisonment and/or $10,000 fines. On or about August 4, a Fillmore County Sheriff’s Sergeant responded to an individual found deceased in the road in southern Fillmore County. The defendant allegedly had been driving his Can-Am, saw something lying in the road, but could not slow down quick enough to stop from hitting it. The defendant’s preliminary breath test allegedly resulted in a .166. The victim had allegedly been walking down the road to cool off following an argument with a female friend at the bar. An autopsy determined that given the injuries to the victim and minimal damage to the Can-Am, it was possible the victim was lying on the road as the defendant claimed.
