On May 7, Kyle Paul Whalen, 47, of Harmony, appeared before District Court Judge Matthew J. Opat. Whalen is charged with Domestic Assault – Commits Act With Intent to Cause Fear, and Domestic Assault – Intentionally Inflicts or Attempts to Inflict Bodily Harm Upon Another. Each is a felony carrying a maximum criminal penalty of five years in prison, a $10,000 fine, or both. On or about May 6, a Fillmore County Sheriff’s Deputy was dispatched to Harmony regarding a domestic assault, as the alleged victim had called the authorities. The defendant, amidst a fight, allegedly put his hands on the victim including around her neck (without cutting off breathing). The victim was allegedly terrified she was going to die and she did not feel safe. The victim allegedly had marks on her neck. The defendant has two prior domestic convictions, Threats of Violence and Violation or Order for Protection, both out of Dodge County.
