On July 27, Joseph Wayne Hinck, 45 of Elma, Iowa, appeared before District Court Judge Jeremy Clinefelter. Hinck is charged with three felonies; Second Degree Burglary – Building – Possess Tool, Third Degree Burglary – Enters Without Consent with Intent to Steal/Commit Felony or Gross Misdemeanor, and Possession of Burglary or Theft Tools. The Second-Degree Burglary charge carries a maximum criminal penalty of 10 years in prison and/or a $10,000 fine. The Third-Degree Burglary charge carries a maximum criminal penalty of five years in prison and/or $10,000 fine. The last offense carries a maximum criminal penalty of three years in prison and/or a $5,000 fine. On or about July 23, a Fillmore County Sheriff’s Deputy was dispatched to an alleged burglary (via surveillance equipment) in rural Chatfield. Through analysis of the equipment, Hinck allegedly used a bolt cutter to gain access to a garage while being seen with a crowbar in another video. The vehicle at the scene allegedly belonged to Hinck. Deputies are familiar with Hinck from previous burglary and theft-related cases in Fillmore County. The man on surveillance, with distinctive head shape, ear height, and build, allegedly matched Hinck’s appearance. Rochester Police were able to take a picture of Hinck’s vehicle, and it matched the one used in the burglary.
