Pursuant to due call and notice thereof, a regular meeting of the School Board of Independent School District No. 227 (Chatfield), State of Minnesota, was held on Wednesday October 7, 2020, at seven o’clock p.m. The following members were present: Jeffers, Isensee, McMahon, Lowrey, Priebe
Member Lanny Isensee introduced the following resolution and Matt McMahon moved its adoption:
RESOLUTION
APPOINTING
A
BOARD
MEMBER
WHEREAS, a “vacancy” in the School Board within the meaning of Minnesota Statutes, section 123B.09, subdivision 5b, presently exists;
WHEREAS, the four-year term for the presently vacant seat began on the first Monday of January 2019, pursuant to Minnesota Statutes, section 123B.09, subdivision 1;
WHEREAS, Minnesota Statutes, section 123B.09, subdivision 5b, requires the Board to fill this vacancy by appointment, which will continue until an individual is qualified under Minnesota Statutes, section 205A.10, subdivision 3, as the successful candidate in a special election conducted for the purpose of electing an individual to serve the unexpired portion of the term of the current vacancy; and
WHEREAS, this appointment will be effective 30 days after the date of the adoption of this resolution, unless a petition to reject the appointee is filed with the School District clerk as provided in Minnesota Statutes, section 123B.09, subdivision 5b(b), within 30 days.
NOW, THEREFORE, BE IT RESOLVED by the School Board of Independent School District No. 227, Chatfield, State of Minnesota, as follows:
1.Effective 30 days after the date of this resolution, Josh Thompson is appointed to fill the current vacancy until an individual is qualified under Minnesota Statutes, section 205A.10, subdivision 3, as the successful candidate in a special election conducted for the purpose of electing an individual to serve the unexpired portion of the term of the current vacancy.
2. If a petition to reject the appointment of Josh Thompson is filed with the School District Clerk within 30 days after the date of this resolution, and meets the requirements of Minnesota Statutes, section 123B.09, subdivision 5b(b), the appointment is ineffective.
The motion for adoption of the foregoing Resolution was duly seconded by Lanny Isensee and upon a vote being taken thereon, the following voted in favor thereof: Jeffers, Isensee, Priebe, Lowrey, McMahon
And the following voted against the same: none
Whereupon said Resolution was declared duly passed and adopted.
I, the undersigned, being the duly qualified and acting Clerk of Independent School District No. 227 (Chatfield), State of Minnesota, hereby certify that the attached and foregoing is a full, true and correct transcript of the minutes of a meeting of the school board of said school district duly called and held on the date therein indicated.
