CITY OF SPRING GROVE AMENDMENTS TO ORDINANCE; CHAPTER 1100;  NON-CONFORMING STRUCTURES

  1. NON-CONFORMING USES AND STRUCTURES
  2. Any structure or use lawfully existing upon the effective date of this Ordinance may be continued at the size and in a manner or operation. The minimum square footage or maximum lot coverage percentage requirements shall not apply to any non-conforming lot that was platted prior to the adoption of this ordinance on August 19th, 2025.  Any such alteration must serve the best interest of the property and receive approval from the planning and zoning officials.  Additionally, accessory buildings or utility sheds may be permitted to encroach upon the required setback if their placement aligns with the location of pre-existing, legally nonconforming structures established prior to the adoption of the current ordinances, thereby maintaining continuous building alignment.
  3. No structural alterations shall be made except as provided in (6) and (7), below.
  4. Whenever a nonconforming structure that is occupied as a principal dwelling unit shall have been damaged by fire, flood, explosion, earthquake, war, riot, or act of God, it may be reconstructed provided that construction details shall conform to the building codes, if this is not possible, approval from the Planning and Zoning Commission shall be required. Reconstruction shall commence within twelve months after such calamity.  
  5. Whenever a lawful, non-conforming structure or use of a building or structure or land is discontinued for a period of one year, any future use of said building or structure or land shall be in conformity with the provisions of this Ordinance.  An exception shall apply to lots that are of insufficient size to meet the requirements of the new ordinances.
  6. Routine maintenance of a building or other structure containing or related to a non-conforming use or structure is permitted, including necessary non-structural repairs and incidental alterations which do not extend or intensify the non-conforming use or structure.
