City of Lanesboro Notice of Approved Ordinance Amendment Summary of Publication Ordinance Chapter 151 – Land Use

Notice is hereby given that Lanesboro City Ordinance Chapter 151 – Land Use has been amended to include Section 151.30 Ashburn Street East Overlay Zone which reads:

  1. Statutory Authorization. This section is adopted pursuant to the authorization and policies contained in the city planning and zoning enabling legislation in M.S. Ch. 462, as it may be amended from time to time.
  2. Purpose and Intent. The Ashburn Street East Overlay Zone establishes modified setback standards along both sides of Ashburn Street East from Parkway Avenue North to the Root River. Its purpose is to maintain the character of adjacent zoning districts while accommodating roadway improvements that reduce setbacks near the right-of-way. This overlay also ensures that property acquisitions for the roadway improvements do not create new non-conforming conditions or worsen existing non-conformities.
  3. Jurisdiction. The provisions of this chapter shall apply to all properties directly adjacent to Ashburn Street East’s right-of-way from Parkway Avenue North eastward to the Root River.
  4. Setback Standards for all properties directly adjacent to Ashburn Street East 

right-of-way:

  1. Front Yards: 16 feet (principal and accessory structures)
  2. Side Yards: 6 feet (principal and accessory structures)
  3. Corner Yards: 16 feet on both street-facing sides (principal and accessory

structures)

  1. In no case can the accessory setback be less than the setback of an 

  adjacent lot which has its front yard on the same street.

  1. Rear Yards: 20 feet (principal and accessory structures)
  2. Special Conditions: Improvements to all existing or proposed structures within the overlay zone can be expanded and/or developed but must follow the setback standards in this Chapter including all legally non-conforming structures.

Other sections within this ordinance chapter were renumbered to include Section 151.30.

A printed copy of the ordinance amendment is available for inspection at City Hall during regular business hours.

The ordinance amendment is effective upon the date of this publication.
