NOTICE OF SHERIFF’S EXECUTION SALE NON-HOMESTEAD PROPERTY
Under and by virtue of an Execution issued out of and under the seal of the District Court of the State of Minnesota, in and for the Third Judicial District and County of Fillmore. On the 17th day of March 2023, upon a judgment rendered and docketed in said Court and said County in an action therein, between Torino Collection, LLC, Plaintiff, and Fred Englehart, Defendant, in favor of said Plaintiff and against said Defendant, for the sum of $550,000 Dollars (plus costs and disbursements) as appears by the judgment roll filed in the office of the Clerk of said District Court for said County, and
WHEREAS, said Judgment was docketed in said Court on March 10, 2023, at 3:00 P.M. and the sum of $550,000, is not actually due thereon with interest of 4 % per diem from March 10, 2023, and up to and including the date of sale, also for all Sheriff’s fees, costs and disbursements of levy and sale,
WHEREAS, said Execution has to the Sheriff of said County been duly directed and delivered,
PLEASE TAKE NOTICE that we have levied upon and will sell at public auction to the highest cash bidder, at the Fillmore County Courthouse, located at 101 Fillmore Street, Preston, Minnesota 55965 on the 7th day of December, 2023 at 10:00 A.M. all right, title, interest that the above-named judgment debtor had in and to the real property, hereinafter described on the 10th of March, 2023, that being the date of rendition of said judgment or any interest therein which said judgment debtors Fred Englehart had since that day acquired the description of the property being as follows, to wit:

Beginning at a point 400 feet North of the Southwest corner of the Northeast Quarter of the Southwest Quarter, Section 29, Township 104 North, Range 8 West; thence North 22 degrees 35 minutes East 482 feet; thence South 38 degrees 05 minutes East 160 feet; thence South 41 degrees 30 minutes West 426 feet to the place of beginning, Fillmore County, Minnesota.
Parcel B: That part of the Northeast Quarter of the Southwest Quarter (NE ¼ SW ¼) of Section 29, Township 104 North, Range 8 West, Fillmore County, Minnesota, described as follows: Commencing at the Northwest Corner of said SW ¼; 1603.77 feet to the centerline of Trunk Highway No. 16; thence Southerly 108.08 feet along said centerline and along a nontangential curve, concave to the West, having a radius of 715.83 feet and delta angle of 08 degrees 39 minutes 03 seconds (chord bears South 12 degrees 27 minutes 47 seconds West and chord length is 107.98 feet); thence South 16 degrees 47 minutes 18 seconds West along said centerline and tangent to said curve, 360.69 feet to the point of beginning of the tract of land to be herein described; thence South 56 degrees 57 minutes 39 seconds East, 217.37 feet to the Westerly Right-of-Way line of a Township Road; thence South 47

Subject to easement for Trunk Highway No. 16 across the Westerly line thereof. Subject to any other easements of record, Fillmore County, Minnesota. (The “Property”).
