NOTICE IS HEREBY GIVEN that the City Council of the City of Preston, Minnesota will meet on the 7th day of November 2022 at 6:00 p.m. at City Hall in the said City to hear, consider and pass upon all written or oral objections, if any, to proposed assessments in respect of MAPLE
STREET IMPROVEMENTS. The proposed assessment roll is now on file in the office of the City Administrator, and open to public inspection by all persons interested. The entire amount assessed against any parcel of land will be payable, unless prepaid, in fifteen (15) equal, consecutive and annual installments, the first of such installments to be collectible with general taxes during the year 2023. The first installments will be payable with interest at the rate of 2.4521% per annum on the entire assessment from the date of the resolution levying said assessments to December 31, 2022, and each subsequent installment will be payable with one year’s interest at said rate on all unpaid installments. However, no interest will be charged if the entire assessment as to any parcel is paid at the office of the Treasurer within thirty (30) days from the date of adoption of the assessment roll, and the owner of any assessed property may at any time prior to November 15th of any year, prepay to the Fillmore County Auditor/Treasurer the whole assessment remaining due with interest accrued to December 31st of the year in which said prepayment is made. Partial prepayment of special assessments following certification has not been authorized by city ordinance.
The general nature of MAPLE STREET IMPROVEMENTS, CITY OF PRESTON, MINNESOTA is as follows: the rehabilitation and or construction and installation of new streets including grading, aggregate base and pavement, along with replacement of concrete curb, gutter, sidewalk and public utilities as needed for the improvement of Maple Street from Ridge Road (CSAH 17 South) to the western termination point in the City of Preston, Minnesota.
The areas proposed to be assessed to cover the cost of said improvements include all lots, tracts or parcels of land in the City of Preston, Minnesota which abut, are adjacent to, or gain access to the above stated streets within the City of Preston, Minnesota, that will be reconstructed and improved as above described.
The total amount proposed to be assessed against the lots, tracts or parcels of land benefited by said improvement is the sum of $22,670.58.
All persons interested may appear and be heard at said time and place.
No appeal may be taken as to the amount of any assessment adopted pursuant to Minnesota Statutes, Sec. 429.061 unless a written objection signed by the affected property owner is filed with the City Administrator prior to the assessment hearing or presented to the presiding officer at the hearing. An owner of property affected may appeal an assessment to the District Court pursuant to Minnesota Statutes, Sec. 429.081 by serving notice of the appeal upon the mayor or administrator of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the mayor or administrator.
Minnesota Statutes, Secs. 435.193 through 435.195 provide for deferment of the payment of special assessments for persons 65 years of age or older and for persons retired by reason of total and permanent disability for whom it would be a hardship to make such payments. Additional information regarding these laws may be obtained at the office of the City Administrator.
