- A default has occurred in the conditions of that certain mortgage executed by Rebecca L. Brand and Aaron Brand, spouses married to each other, as mortgagors, in favor of Mortgage Electronic Registration Systems, Inc. (“MERS”), as nominee for Bremer Bank, National Association, a national banking association, MIN: 1000739-0000006940-2 (“Bremer”) as mortgagee, dated June 16, 2017, and recorded on June 29, 2017, as Document No. 413289, as assigned to Bremer, by MERS, pursuant to that certain assignment of mortgage dated March 18, 2025, and recorded on March 28, 2025, as Document No. 450038, both in the Office of the County Recorder in and for Fillmore County, Minnesota (“Mortgage”). The land described in the Mortgage is not registered land.
- The original principal amount secured by the Mortgage was: $155,103.00.
- No action or proceeding at law is now pending to recover the debt secured by the Mortgage or any part thereof.
- The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage and all notice and other requirements of applicable statutes.
- As of the date of this notice, the amount due on the Mortgage is: $145,929.48.
- Pursuant to the power of sale in the Mortgage, the Mortgage shall be foreclosed, and the land located at 301 Kirkwood Street East, Lanesboro, Minnesota 55949, Property Tax ID No. 190279000, and legally described as follows:
All of Lot 1 and Lot 2 and a strip of land in the Northwest Comer of Lot 3, said strip being 6 feet North and South and 30 feet East and West, all in Block 43, First Addition to the Village, now City, of Lanesboro, Fillmore County, Minnesota. (“Property”), shall be sold by the Sheriff of Fillmore County, Minnesota, at public auction on Thursday, June 12, 2025 at 10:00 a.m., at the Fillmore County Courthouse: 101 Fillmore Street, Preston, Minnesota 55965.
- The time allowed by law for redemption by mortgagors or mortgagors’ personal representatives or assigns is 6 months after the date of sale.
- The mortgagors must vacate the property on or before 11 :59 p.m. on Friday, December 13, 2025 if the Mortgage is not reinstated under Minn. Stat.§ 580.30 or the property is not redeemed under Minn. Stat.§ 580.23.
- THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGORS, THE MORTGAGORS’ PERSONAL REPRESENTATIVES OR ASSIGNS, MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINN. STAT. § 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.
