CITY OF SPRING VALLEY STATE OF MINNESOTA, COUNTY OF FILLMORE SUMMARY PUBLICATION OF ORDINANCE 2023 – 46 ZONING ORDINANCE

On October 9, 2023, the City Council of the City of Spring Valley, Minnesota voted to approve its new Zoning Ordinance which repeals and replaces Spring Valley City Code Section 154, titled “ZONING”. The Council approved publishing the summary of the Ordinance rather than the entire text, pursuant to Minnesota Statute 412.191, subd. 4. The full Ordinance text is available for inspection by any person during the City’s regular business hours at 201 South Broadway, Spring Valley, Minnesota.
SUMMARY OF FLOODPLAIN ORDINANCE NUMBER 2023 – 46
The Ordinance is adopted to streamline development processes, clarify certain sections, and update the code for new development types. The Ordinance applies to all lands within the jurisdiction of Spring Valley, Minnesota and covers topics such as, but not limited to: zoning districts; permitted, conditional, and interim land uses; performance and design standards; overlays; planned unit development; planning commission and board of adjustment; signage; and parking. The following examples are not meant to be completely inclusive of all changes made, but a highlight of major amendments. The new ordinance provides a table for land uses and performance standards across all zoning districts and creates a new zoning district for greenspace and civic uses, like parks. The overall code was updated to be compliant with State Statute regarding variance and provide more flexibility for residential development. The signage section was made content-neutral to comply with recent Supreme Court rulings at the Federal level. A new process for regulating cell towers is available. The planned unit development process and floodplain controls were made into overlays and a new overlay was made over properties downtown to allow mixed-use development. The process for annexation was included to provide some annexation guidance within code at a local level. Definitions were amended or added to be Federally compliant, such as shifting from “churches” as a definition to “places of worship”.
The Ordinance repeals and replaces the existing City of Spring Valley City Code Section 154.
