The Fillmore County Planning Commission held a public hearing on August 18 to discuss a proposed amendment to Section 604.05(5), lot width regulations, of the county’s zoning ordinance.
The current regulation requires a minimum width of 150 feet at the front of a buildable lot, plus a provision that the lot shall have either 66 feet of public road frontage or a recorded private easement of not less than 66 feet for access.
The proposed amendment will still require a minimum width of 150 feet at the front of a proposed building site but will require only 33 feet of public road frontage or a recorded private easement of not less than 33 feet for access to the site.
There were no comments from the public or from township officers on the proposed amendment. Zoning Administrator Cristal Adkins said she had received input from a surveyor who was in favor of the amendment as proposed. Also, the county attorney and county engineer supported the proposed amendment.
A motion to send the proposed amendment to the county board for its consideration was approved.
Board of Adjustment
Three public hearings were held on requests for variances. There was no comment from the public or township officers on any of the applications.
Michael Apenhorst, section 35 of Forestville Township, requested a variance from the required setback from the center of the road (CR 14) to construct a silage bunker with a concrete floor. Apenhorst explained the silage bunker is to be dug into a hill with dirt sides and it will have a concrete floor. The 27-foot variance (allowing the bunker to be 73 feet from the center line of the road) was approved.
Brett Pederson and Debra Mjelde, section 9 of Fillmore Township, requested a variance from the required setback from the center line of the road (CR 8) for the construction of a timber framed building on an existing 12 foot by 18-foot slab of concrete. Pederson explained they wanted to build a small woodworking shop on the existing slab of concrete, which will require an 18-foot variance. The variance was approved.
Tammi and Kevin McKinney, section 17 of Arendahl Township, have requested a variance from Section 501 of the county’s Sub-Surface Sewage Treatment System (SSTS) Ordinance in order to construct a Type III septic system on a new building site. This will refer to Minnesota Rules, chapter 7082 (3)(F).
Adkins explained the Minnesota Pollution Control Agency has a rule in place as to whether a site is buildable. A property owner must have a location on the property for the installation of a Type I septic system (below ground). Adkins noted this property is too rocky for the installation of a Type I system. The Type III system is a design for a worst-case scenario. It is not an in-ground system and requires more monitoring, as it is a higher risk system. The mound system is installed over three foot of sand and is more expensive to install. The variance was approved as presented.
