Merkel, Sara Warren, and Bernard Murphy Farms, LP #18099; and all successors and assigns; also the unknown heirs of the aforesaid persons, and all other persons unknown claiming any right, title, estate, interest, or lien in the real estate described in the Complaint, subject to any easements of record,

THIS SUMMONS IS DIRECTED TO THE ABOVE-NAMED DEFENDANTS:

1.YOU ARE BEING SUED. The Plaintiff has started a lawsuit against you. The Plaintiff’s Complaint against you is on file in the office of the court administrator of the above-named court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though there may be no court file number on this Summons.

2.YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS.  You must give or mail to the person who signed this summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at:

3.YOU MUST RESPOND TO EACH CLAIM.  The Answer is your written response to the Plaintiff’s Complaint.  In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiff should not be given everything asked for in the Complaint you must say so in your Answer. 

4.YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO
THE PERSON WHO SIGNED THIS SUMMONS.
If you do not answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiff everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint. 

5.LEGAL ASSISTANCE. You may wish to get legal help from a lawyer. If you do not have a lawyer, the Court Administrator may have information about the places where you can get legal assistance.  Even if  you cannot get legal help, you must still provide a
written Answer to protect your rights or you may lose the case.

6.ALTERNATIVE DISPUTE RESOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice.  You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute. 

7.THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in Fillmore County, State of Minnesota, legally described as follows:  

That part of the Northwest Quarter of the Southwest Quarter (NW 1/4 SW 1/4) and that part of the Southwest Quarter of the Southwest Quarter (SW 1/4 SW 1/4) of Section 8, Township 103 North, Range 13 West, Fillmore County, Minnesota, described as follows: Commencing at the Northwest Corner of said NW 1/4 SW 1/4; thence South 00 degrees 30 minutes 19 seconds East (assumed bearing) along the West line of said NW 1/4 SW 1/4, 704.83 feet to the centerline of County State Aid Highway No. 8 and to the point of beginning of the tract of land to be herein described; thence South 41 degrees 53 minutes 50 seconds East along said centerline, 775.82 feet; thence Southeasterly 63.39 feet along said centerline and along a tangential curve, concave to the Northeast, having a radius of 4583.66 feet and delta angle of- 00 degrees 47 minutes 32 seconds (chord bears South 42 degrees 17 minutes 36 seconds East and chord length is 63.39 feet) to the North line of said SW 1/4 SW 1/4; thence North 88 degrees 51 minutes 27 seconds West not tangent to said curve and along said North line, 21.45 feet to a point 534.00 feet Easterly of the Northwest Corner of said SW 1/4 SW 1/4 (when measured along said North line); thence South 45 degrees 08 minutes 33 seconds West, 198.00 feet; thence North 88 degrees 51 minutes 27 seconds West parallel with said North line of said SW 1/4 SW 1/4, 392.36 feet to the West line of said SW 1/4 SW 1/4; thence North 00 degrees 30 minutes 19 seconds West along said West line, 142.49 feet to the Southwest Corner of said NW 1/4 SW 1/4; thence continuing North 00 degrees 30 minutes 19 seconds West along said West line of said NW 1/4 SW 1/4, 613.31 feet to the point of beginning and containing 5.42 acres, more or less. Subject to easement for County State Aid Highway No. 8 across the Northeasterly line thereof. Subject to any other easements of record.

8. The object of this action is to determine that the Defendants have no right, title, estate, interest, or lien in or on the above-described real estate.

NOTICE OF NO PERSONAL CLAIM.  No personal claim is made against any of the Defendants in the action above entitled.
