Felony Charges
Diane Elizabeth Dungy, 34, of rural Harmony, is free after posting $10,000 bond after being charged with felony possession of a controlled substance. Dungy appeared in District Court on Monday, November 13, 2006.
According to court records, the Southeast Minnesota Gang Task Force carried out a search warrant of the Dungy residence on November 2. A canine search found 2.9 grams of methamphetamine, .7 grams of cocaine, and a pipe that held traces of marijuana. It is alleged that these were in the possession of Dungy.
Dungy is charged with three felony counts of possession of a controlled substance. She is also charged with permitting her children to be exposed to methamphetamine, a felony, as well as child neglect.
Judge James Fabian scheduled Dungy's next court appearance for December 4, 2006.
Also facing drug charges along with Dungy is Matthew Robert Engen, 23, of Canton. Engen was charged with felony possession of methamphetamine. Engen was free after posting $3,000 bond.
According to the criminal complaint, Engen was at the Dungy residence when a search warrant was being executed. It is alleged that a search of Engen's person found methamphetamine.
In addition to the possession charge, Engen is also charged with permitting children to be exposed to methamphetamine, a felony, as well as child neglect.
Engen has requested that a public defender be appointed to represent him. His next court appearance is on December 4, 2006.
Nicholas William Konen, 20, of Cresco, was charged in District Court with felony theft by check.
According to court records, it is alleged that on July 5, 2006, Konen bought a 1998 Chevy S-10 Blazer from a Canton auto dealership, paying $3887 from a checking account that had been closed.
Judge James Fabian released Konen on his own recognizance. His next court appearance is scheduled for December 4, 2006.
