Richard Ernst, 33, of Canton appeared before Judge Robert R. Benson in District Court Monday June 6, 2011, for sentencing. Attorney for the defendant was Fred Suhler; prosecuting attorney was Brett Corson. Based on the defendant's plea of guilty to count 3- theft, the court found him guilty. The penalty for that count is five years, $3,000, or both. The remaining charges of theft, 2nd degree burglary, and 3rd degree burglary were dismissed. The court ordered that the sentence be stayed for five years, and the defendant placed on supervised probation for five years. He also ordered Ernst be committed to the MN Correctional Facility in St. Cloud for 12 months and one day. Credit was given for two days for time already served. He must spend at least 2/3 of that time in the prison. He was also ordered to pay a $1,000 fine, plus restitution, fees and surcharges, for a total of $1,780.33. He must also submit to random testing and searches, provide a DNA sample, not drink or possess alcohol or drugs, not enter bars or liquor stores, and not possess firearms.

Also appearing before Judge Robert Benson on June 6, 2011, was Paula Jean Rodriquez, 40, of Granger. Rodriquez was making her first appearance in court regarding and incident that happened on April 14, 2011. The defendant's attorney was David Haugen; Brett Corson was the prosecuting attorney. The first count Rodriquez was being charged with was aiding an offender to avoid arrest- harbor/conceal. The maximum penalty for this is 3 years, $5,000, or both. Count 2 was Obstruction of the Legal Process, which brings a maximum penalty of 90 days in jail, $1,000, or both. Department Captain John DeGeorge and Chief Matt Schultz reported they were looking for Jaremy Volkman, as he had allegedly assaulted someone. They found his vehicle outside the home of Paula Rodriquez. She allegedly denied that he was there, then agreed to a search and admitted he was in her home. Rodriquez was released on her own recognizance. She must not leave the state of Minnesota or Iowa. She signed a waiver of extradition and completed the booking process.

David Dean Zimmer, 47, of Mabel, appeared before Judge Robert Benson on Monday, June 13. The defendant's lawyer was Lawrence Maus; prosecuting attorney was Brett Corson. Zimmer was charged with one count of 1st degree sale of 10 grams or more of cocaine/heroin/meth within a 90-day period. Maximum penalty for this count is 30 years, $1,000,000 or both. Count 2 was 2nd degree possession of 6 grams or more of cocaine/heroin/meth, with a maximum penalty of 25 years, $500,000 or both. Count 3 was 2nd degree possession of 6 grams or more of cocaine/heroin/meth. The maximum penalty is 25 years, $500,000 or both. Zimmer posted $50,000 bail on the conditions that he doesn't leave Minnesota without approval, does not consume or possess alcoholic beverages, and no narcotic drug use unless prescribed by a doctor. He must also submit to drug testing. On May 20, 2011, Deputy Investigator David Dyke obtained a warrant to search Zimmer's home in Mabel. The Southeast Minnesota Narcotics Task Force found Zimmer in his home, as well as a large amount of cocaine that was allegedly intended for sale.
