On Monday, June 27, Veronica Juneau (a.k.a. Soukup), 22, appeared before Fillmore County Judge Robert Benson for sentencing. The prosecuting attorney was Brett Corson. The defendant waived her right to legal representation. She pled guilty to Count 2 - Theft, which holds a maximum penalty of 10 years in jail, $20,000, or both. The other charges were dismissed. The court sentenced Juneau to 30 days in the Fillmore County Jail on a Work Release, and placed her on 10 years probation. Juneau must pay a fine of $1,000, along with $1,057 in restitution, totaling $2,057. She must also write a letter of apology to the victim within ten days of sentencing. She must have no contact with her husband, Jonathan Juneau, except for divorce proceedings. She must remain law-abiding, she cannot use or possess alcohol or controlled substances, and she cannot enter bars or liquor stores. She must also submit to random testing, and cannot possess firearms.
Jamie Edward Peck, 31, of Fountain, made his first appearance before Judge Robert Benson on Monday, July 11. Peck was arrested on July 10 for operating a motor vehicle under the influence of alcohol. The maximum penalty for this is seven years in jail, a $14,000 fine, or both. Count 2 was having a blood alcohol level above .08 within two hours of being arrested. The maximum penalty is one year, $3,000, or both. Peck's blood alcohol was measured at .20. Count 3 was for receiving a DWI with prior arrests. It was discovered that Peck had three prior alcohol-related license revocations. These happened on November 2, 2002, March 21, 2004, and June 10, 2011. Peck was released on his own recognizance, with a $12,00 unconditional bail. He may not drive a vehicle without a license, possess or consume alcohol, and must have electronic home monitoring and daily alcohol testing.
On Monday, July 11, Debra Jean McCabe, 50, of Spring Valley, went before Judge Robert Benson for sentencing. The prosecuting attorney was Brett Corson and Frederick Suhler was the defense attorney. The defendant was found guilty of Wrongfully Obtaining Assistance- theft by false statements, which has a maximum penalty of 10 years in jail, $20,000, or both. She was also found guilty of Perjury for lying on an application for public assistance. The maximum penalty is five years in jail, $10,000 or both. All other charges were dismissed. The court sentenced McCabe to pay a $2,000 fine, along with restitution, for a total of $84,149.40. She was also sentenced to 30 days at the Fillmore County Jail on a work release, and ten years probation.
Derek Lee Allen, 24, of Viola, MN was also brought before Judge Benson on July 11 for sentencing. Brett Corson was the prosecuting attorney, and Frederick Suhler the defense attorney. The court found Allen guilty of a Violation of a Domestic Abuse No Contact Order that runs until 10/26/14. The maximum penalty is five years in jail, $10,000, or both. The defendant was sentenced to 21 months in a Minnesota Correctional Facility at St. Cloud, which was stayed for five years. He must spend 90 days at the Fillmore County Jail on a work release, with 21 days credit given for time served. He was also given five years probation, in which he must have no contact with the victim, not consume or possess alcohol or drugs, and not enter bars or liquor stores. He must also attend domestic abuse outpatient treatment and pay $2,390 in fines.
