Spring Valley man sent to prison for 12 years

Felony Sentencing
Eric Robert Smith, 39, of Spring Valley, was sentenced to 12 years in prison on Monday, August 14, after pleading guilty in Fillmore County District Court to two felony counts of criminal sexual conduct. All other charges were dismissed as part of the plea agreement.
According to court records, Smith admitted to have sexual contact with two female minors around July 2005. One girl was 10 at the time, the other was 9.
Judge Robert Benson sentenced Smith to 21 months in prison and fined him $6,000 for criminal sexual contact with the 9 year old girl. Benson then sentenced Smith to 144 months in prison and fined him $6,000 for criminal sexual contact with the 10 year old female. The prison time will be served concurrently. Smith was given credit for time served.
Fillmore County Attorney Brett Corson represented the state. Smith was represented by Rochester attorney, Gary Gittus.
Felony Charges
Sharon Kay Kinnear, 51, of Wykoff, was charged in District Court on Monday, August 14, with one felony count of fraud related to an incident in Spring Valley between May and June 2007.
According to the criminal complaint, it is alleged that Kinnear used a debit card belonging to a woman to purchase several items valued at around $250 without the victim's consent. Kinnear apparently cleaned the victim's house and had access to her purse.
In addition to the felony fraud charge, Kinnear is also charged with misdemeanor charges of fraud and theft.
Judge Benson released Kinnear on her own recognizance pending her next court appearance on October 15, 2007.
