Winona man sent to prison for theft by check

• Jason Paul Fawcett, 31, of Winona, was sentenced in Fillmore County District Court on Monday, December 3, to 21 months in prison after pleading guilty to theft by check.
According to court documents, in April 2007 Fawcett opened up an account in his daughter's name at Marine Credit Union in Peterson using checks written on closed accounts. Several deposits were made from a variety of financial institutions. Fawcett later withdrew money from the account.
Fawcett was given credit for 201 days served in jail.
• Ryan Lee Allen, 19, of Chatfield, was charged in District Court on Monday, December 3, with four felony counts of criminal sexual conduct related to an incident in August 2007.
According to the criminal complaint, it is alleged that Allen was involved sexually with a female minor who was 13 at the time of the incident.
Allen has denied the allegations and has asked the court to appoint a public defender. Judge Robert Benson released Allen on his own recognizance on several conditions, including that he have no contact with the victim, nor have any unsupervised contact with anyone under 18 years of age.
• Percy Lee Withey, 73, of Spring Valley, was charged with making terroristic threats, assault and disorderly conduct stemming from an incident in Spring Valley on September 11, 2007.
According to court records, it is alleged that Withey entered a law office in Spring Valley and wanted land he owned transferred to a bank within three days, and if this was not done he would shoot the person he was talking to as well as people at the bank.
Judge Robert Benson has ordered a competency hearing, before proceeding with the case.
