PRESTON - Benjamin Wayne Blaschka, 32, of Winona, was sentenced in Fillmore County District Court on Wednesday, January 30, 2008, by Judge Robert Benson to 39 months in prison. On November 6, a twelve person jury found Blaschka guilty on seven of nine charges related to an incident in Stumpy's bar Rushford on February 7, 2006, including two felony counts of assault and making terroristic threats.

Judge Benson sentenced Blaschka to 39 months in prison on each of the two felony counts, with sentencing to run concurrently. He was given credit for 312 days served in jail. Benson did not sentence Blaschka on the other five misdemeanor counts, determining that it was the same behavior as the two greater charges.
