Felony Sentencing

• Santiago Jaimez Garcia, 30, of Preston, was sentenced on Monday, May 5, 2008, in Fillmore County District Court by Judge Robert Benson to two years probation after pleading guilty to assaulting a correctional employee, a felony. He was also ordered to serve 51 days in jail and fined $1000.

Garcia admitted in court to spitting on a jailer at the Fillmore County Jail on March 15, 2008 after being arrested for driving while under the influence of alcohol.

It was learned during Garcia's incarceration and court hearing that he is an illegal immigrant. Judge Benson ordered that Garcia remain in custody until such time as he will be deported.

Mr. Garcia was represented by Public Defender Fred Suhler, Jr.

Felony Charges

• Jerad Reicher McCann, 21, of Hammond, MN, was charged in District Court on Monday, May 5, 2008 with fleeing a police officer, a felony. In addition, he was charged with obstructing the legal process, as well as five traffic violations, including operating a motorcycle without a license endorsement.

According to court documents, it is alleged that McCann was riding a motorcycle three abreast with two other motorcyclists on County Road 17 near Preston on April 4, 2008. When a police officer pulled the three men over and stepped out of his vehicle, McCann took off on his motorcycle. The police officer gave chase, but was unable to catch up to McCann. McCann turned himself in to authorities the following day.

Judge Robert Benson released McCann on his own recognizance, pending his next court appearance on June 30, 2008. He is being represented by Rochester attorney, Anna Restovich.
