Shooting victim faces several charges

PRESTON - A criminal complaint was filed in Fillmore County District Court on Tuesday, February 10, charging Dylan Dean Westby, 20, of Rushford, with three felony counts of burglary, making terroristic threats and assault. Westby is expected to make his first court appearance on Monday, March 2, 2009.

The charges stem from a disturbance at the residence of Matthew Soppa in Norway Township in the early morning hours of February 1. During the incident, Westby was shot in the leg by Soppa. No one else has been charged in the incident.

According to the criminal complaint, it is alleged that Westby got into a fight with Soppa, believing that Soppa was involved with Westby's girlfriend. During the fight, Westby allegedly threatened to kill Soppa. Westby also assaulted his girlfriend. Both assaults apparently happened in a new house under construction. The girlfriend was later taken by ambulance to be treated for her injuries.

After the fight, Soppa asked Westby to leave the premises and threatened to shoot Westby if he came into the house where he lived. When Westby disregarded his warning, Soppa fired three warning shots before shooting Westby in the leg with a .22 Magnum. Soppa then called the police.

Westby was treated for his gunshot wounds at Winona Community Memorial Hospital, who alerted the Winona County Sheriff's Office.

The three burglary charges involve Westby entering a dwelling without consent with the intent to commit a crime. He is also charged with making terroristic threats, assault and domestic assault.

According to law enforcement, alcohol played a role in the incident.

Felony Charges

Bradley James Alexander, 22 of Preston, was charged in District Court on Tuesday, February 10, with two felony counts of making terroristic threats and domestic assault by strangulation.

According to court documents, it is alleged that on February 9, 2009, Alexander assaulted his wife during a domestic disturbance, at one point grabbing her by the neck and threatening to kill her. Alexander is also charged with gross misdemeanor charges of domestic assault and assault.

Judge Robert Benson set conditional bail at $5,000 and unconditional bail at $15,000. A no contact order has been filed in the case.

Alexander is scheduled to appear in court on February 18, 2009.
