Preston woman sentenced for theft of DAC funds

Rebecca Jo Kellogg, 42, of Preston, was sentenced by Judge Robert Benson in Fillmore County District Court on Monday, March 16, 2009 to 20 years probation, ordered to serve 180 days in jail and pay restitution of $54,260.98. As part of a plea agreement, Kellogg pled guilty to one count of theft by check with all other charges being dismissed.

Kellogg admitted in court on January 5, 2009 that she forged checks to herself between March 2006 and April 2008 while working as a bookkeeper at the Fillmore County Development Achievement Center. A total of 97 checks were issued totalling more than $53,000.

Judge Robert Benson stayed imposition of sentencing for 20 years. In addition to jail time and restitution, Kellogg was ordered to pay $138 in fines and perform 1,000 hours of community service.

Kellogg was represented in court by public defender Fred Suhler, Jr.

Felony Charges

• Melissa Ann Lowy, 40, of Eleva, WI, was charged in District Court on Monday, March 16, 2009, with four counts of criminal vehicular operation of a vehicle.

According to court documents, it is alleged that on July 1, 2008, Lowy operated a vehicle while under the influence of alcohol causing substantial harm to a Preston man. Police records show that Lowy had a blood alcohol level greater than .08 at the time of the incident. A review of Lowy's driving record indicated that she had a prior DUI conviction on October 10, 2006.

• Collin Daniel Portillo, 19, of Peterson, was charged in District Court on Monday, March 16, 2009, with making terroristic threats, a felony. He is also charged with misdemeanor assault and disorderly conduct.

According to the criminal complaint, it is alleged that on January 16, 2009, Portillo sent a threatening text message and voice mail to a Rushford man.

• Eric Lee Walton, 19, of Spring Valley, was charged in District Court on March 23, 2009, with violating a restraining order.

According to the police complaint, on February 14, 2009, Walton was in the company of a female minor while a restraining order that was issued on January 31, 2008, was in place.

Judge Robert Benson set conditional bail at $2000. Walton was released after posting bail and is scheduled to appear in court again on April 6, 2009.
