Section 144.496 of the Minnesota Statutes, also known as the Minnesota Radon Awareness Act, becomes effective on January 1, 2014. Pursuant to this statute, duties are placed on sellers of residential property to advise buyers if and when radon testing has been done, the results of the testing, as well as any mitigation efforts made. In addition, there are notice requirements for sellers, specifically to provide a form to buyers called “Radon in Real Estate Transactions.” As there are exceptions to the law, it’s important to review it closely and ask questions.
