Board seat to be vacant 30 days

Even with the best of planning, it appears that the Fillmore County Third District Commissioners seat will be vacant a minimum of 30 days.

Commissioner Gary Peterson announced at the January 23 county board meeting that he would be resigning the seat he has held for the past 16 years. In a written announcement, Peterson said that he will be leaving this table (county board) as soon as the people of my district elect a replacement.

But it now appears that a seamless transition will not be possible. According to Fillmore County Auditor Angela Burrs, election law dictates that a special general election cannot be held less than 30 days or more than 60 days after the seat becomes vacant. Consequently, regardless of when Peterson officially steps down, the third district seat will be vacant a minimum of 30 days.

Burrs is thinking that the special general election will be held sometime between April 3 and April 17, depending when Petersons last official day in office is.

Once we know the exact date that Commissioner Peterson vacates the office, we can then set the filing period for candidates, Burrs said.

Burrs went on to say that a special general election needs to follow all of the procedures of a general election, including advertising the filing dates, having ballots printed and getting election judges and precincts prepared. She also said that in the event that there are more than two candidates for the post, a primary election will need to be held. That will also require ballots being printed up.

Burrs said that she hopes that any primary election could take place on March 13 when township elections are taking place.

The Fillmore County Board is expected to discuss the Third District vacancy and set dates for the special general election at their February 6 meeting.
