Appearing before Judge Gerald Wolf in District Court Thursday, February 17, 2011, was Jacob Arthur Alan Groth, a 25-year old male from Austin, MN. Groth faced one count of first degree burglary and one count of trespassing. If convicted on both counts, he could face a maximum of 20 years in prison, 90 days in county jail and fines totaling $36,000.00. On February 16, Deputy Kevin Beck was dispatched to the Subway sandwich shop in Spring Valley in answer to a call he received regarding an individual acting strangely and trying to get into the store before it was open. He claimed he was reporting for work, but the caller indicated that he is not employed there.
In the meantime, another individual called Subway to make sure everything was okay when she saw the man trying to get into the store. This caller claimed that she woke up early that morning to a noise downstairs and when she got up to investigate, came face-to-face with an intruder. She was able to chase him out of her house.
Upon arriving in Spring Valley, Deputy Beck took a statement from the person at Subway who said the last time she saw the man, he was headed toward the Dairy Queen. Before checking that out Deputy Beck made sure the other person whose home had been invaded was okay. He took a brief statement from that person before tracking down the alleged trespasser. Deputy Beck found a man wandering around the parking lot at Dairy Queen who said his name was Jacob Groth. He seemed confused and said he was from Austin but was visiting a friend in Spring Valley. Officer Beck didn't recognize the name and Groth couldn't remember where the friend lived. Groth claimed the reason he had been in a stranger's house is because he had been sleepwalking. Beck had a dispatcher contact the sheriff's office in Mower County. They reported that Groth had been arrested for burglary and theft of an occupied residence. State Trooper Troy Christianson and Sheriff Jenson were also at the scene to assist Deputy Beck, who took Groth into custody and transported him to the Fillmore County Jail in Preston. Judge Wolf set conditional bail at $2,000.00 and unconditional bail at $10,000.00. Groth's next court appearance is March 1, 2011.
