Notice of real estate sale
Fillmore County, (hereinafter “County”) is offering for sale approximately 464 acres of real estate located in Fillmore County, Minnesota, described as follows:
PARCEL A: 229 acres, more or less, located in Sections 32 and 33, Township 103 North, Range 10 West, which lies south and east of the South Branch of the Root River, and
PARCEL B: 235 acres, more or less, located in Section 5, Township 102 North and Section 32, Township 103 North, all in Range 10 West which lies west of the South Branch of the Root River;
PARCEL C: Combination of both Parcel A and Parcel B (all real estate).
THE SPECIFIC LEGAL DESCRIPTION FOR THE ABOVE PARCELS ARE AVAILABLE BY CONTACTING THE FILLMORE COUNTY COORDINATOR, KAREN BROWN, AT HER ADDRESS AND TELEPHONE NUMBER LISTED BELOW.
The above describe parcels contain a total of 464 acres, more or less which are located near Preston, Minnesota and within the Fillmore Central School District. Two former demolition landfills are located on Parcel A and the property is subject to the right of way for a recreational bike trail, a DNR fishing easement, as well as zoning rules and regulations and other rights, easements, or restrictions of record. The property is also subject to a farm rental agreement.
The property will be sold on a sealed bid basis for cash. No additional survey of the property will be done by County. The property is being sold AS IS without any warranties regarding the condition of fencelines, rights of access, or any other condition of the property. There shall be no responsibility on the part of County to remove debris, make repairs or improvements, or perform any other act to change the condition of the property since it is being sold AS IS. Real estate taxes due and payable in the year 2004 will be prorated. Possession and closing will be on or before November 15, 2004. Conveyance will be by limited warranty deed subject to reservation of all mineral rights by County.
The property may be inspected or additional information obtained at the Fillmore County website www.co.fillmore.mn.us or by contacting Karen Brown, Fillmore County Coordinator, Fillmore County Office Building, 902 Houston Street, P.O. Box 466, Preston, MN 55965 (507) 765-4566.
The terms of sale are cash at the time of closing. Ten percent (10%) of the purchase price must be submitted as earnest money with the written sealed bid. The earnest money check must be by certified or cashiers check. If the bid is not accepted by County, the 10% earnest money shall be returned.
Written sealed bids will be accepted by Karen Brown, Fillmore County Coordinator at the above address until 12:00 o’clock noon on August 20, 2004. No written sealed bids shall be accepted after the above specified date and time. The written bid shall contain the 10% earnest money check as well as the bidder’s name, address, telephone number, total cash price offered and parcel or parcels for which the bid is submitted. The sealed bids shall then be opened and considered at the County Commissioner’s meeting at 10:00 a.m. on August 24, 2004. County reserves the right to reject any and all bids and to sell the property as one parcel or in separate parcels depending upon the highest amount of money which can be obtained for the sale of all the real estate. After all bids have been reviewed, the successful bidder or bidders will be required to execute a purchase agreement with the County and the earnest money of ten percent (10%) submitted with the sealed bid shall be held by the County treasurer until closing.
