Amended Interim Zoning OrdinanceWhereas, Sumner Township found that zoning controls regulating residential development within the Township are necessary to protect the health, welfare and safety of its citizens; andWhereas, Sumner Township adopted an interim zoning ordinance on April 5, 2003, set to expire on April 1, 2004, unless otherwise terminated, extended or replaced, by action of the board; and it extended the ordinance to October 1, 2004; andWhereas, Minn. Stat. � 462.355, Subd. 4, authorizes the interim prohibition of any use, development or subdivision for a period of one year, plus an additional 18 months, if necessary, in order to study its needs for a zoning ordinance; andWhereas, the townships study has been actively worked on, but is not yet complete and ready for consideration.Now, therefore, the board of supervisors of Sumner Township by Resolution adopted on July 26, 2004, extended the ordinance providing that no zoning permit, or building permit, shall be issued for any new residential building construction or use on parcels of land smaller than 80 acres within the township, nor shall any such use be permitted within the township or any new feedlot greater than 500 animal units, for an additional twelve months to October 1, 2005, at which time this Interim Ordinance shall expire, unless otherwise terminated, extended or replaced, by further action of the board. This interim zoning ordinance shall not prohibit remodeling, enlarging, replacing, or upgrading any existing residential structure on the same general building site as the presently existing structure.Zoning authorization for any new residential use, any new or expanded feedlot, or any remodeling, enlarging, replacing, or upgrading of any existing residential structure within the Township must be received from the Township prior to the commencement of such work.
