CITY OF FOUNTAIN

ORDINANCE 93

AN ORDINANCE ESTABLISHING A PENALTY FOR VIOLATING CITY OF FOUNTAIN ORDINANCE NUMBER 93, WHICH PROHIBITS ILLEGAL DISCHARGE OF WATER OR LIQUID INTO THE CITY OF FOUNTAINS WASTEWATER TREATMENT SYSTEM.

The City of Fountain Does Ordain:

WHEREAS, the City of Fountain has adopted ordinance number 65, which prohibits illegal discharge of water or liquid into the City of Fountain�s sewage or wastewater treatment system; and

WHEREAS, ordinance number 65 does not specify a penalty for violation and

WHEREAS, the Fountain City Council as passed a resolution adopting a penalty for such violation of the aforesaid prohibition under ordinance number 93;

NOW THEREFORE; Commencing May 1, 2005, the penalty for violating City of Fountain Ordinance number 65, which prohibits illegal discharge of water or liquid into the City of Fountain�s sewage or wastewater treatment system, shall be $500.00 per occurrence. This penalty shall be assessed to the owner of the real property from which said discharge has occurred.

The City of Fountain reserves its right to pursue an other remedies that it may have, such as an action for an injunction.
