Zoning Ordinance

Whereas, Sumner Township found that zoning controls regulating residential development within the Township are necessary to protect the health, welfare, and safety of its citizens; and

Whereas, Minn. Stat. § 462.351, et seq. authorizes the adoption of such controls, including those more restrictive than those in effect in the County; and

Whereas, the Township has thoroughly studied the need for such controls, and it has held hearings to gain public input regarding those controls;

Now, therefore, the board of supervisors of Sumner Township ordains as follows:

1. The zoning ordinance of Fillmore County is hereby adopted by reference as the Township’s zoning ordinance, including its present fee structure, subject to the following more restrictive provisions.

2. No subdivisions shall be allowed in the Township.

3. Residential housing must be on a minimum 5-acre lot size within 80 contiguous acres owned by the same party. If the 5 acres minimum lot sized parcel is being sold, the seller must show ownership of 80 contiguous acres from which the 5-acre parcel is being split. Residential housing must be set back 2,000 feet from any existing feedlot, 1,500 feet from any existing house, and 500 feet, or less, from the centerline of any public road.

4. No campgrounds over 2 campsites shall be allowed in the Township.
