An ordinance allowing parking of certain trailers on city property near the brush dump in the city of Lanesboro. and prohibiting the parking of those trailers at the dnr/city of lanesboro parking lot or other public locations

The City of Lanesboro does hereby ordain:

Subd. 1. Background and Purpose.

The City of Lanesboro is a center for significant level of recreational activity, including camping, canoeing, tubing and the like. Located in the City of Lanesboro are private businesses that provide rentals of equipment for recreational activities such as canoeing and tubing. These businesses are a vital part of the economy of Lanesboro. Such businesses utilize trailers and the like equipment for the transportation and storage of said tubes and canoes, and places to maneuver and temporarily locate those trailers in the City of Lanesboro have been hard to obtain. The problem is compounded by the unique topography of Lanesboro which seriously limits the availability of land, public or private upon which to maneuver and temporarily park said trailers. This has caused some businesses to park their trailers at inappropriate public locations such as in the public parking lot near the DNR financed Lanesboro Mill Pond parking lot. The City of Lanesboro wants to eliminate the parking of trailers at those locations. For these reasons the City finds that it is necessary to provide for limited parking on what is available land near the Lanesboro Brush Dump in the City of Lanesboro.

Subd. 2. Intent and Regulation.

The City of Lanesboro does hereby allow the parking of private canoe and tube (for tubing) trailers, and the canoes and tubes located thereon, at such sites as are set aside for that purpose near the brush dump in Lanesboro, Minnesota. An application to park a trailer on at said location at spot marked by the City for that purpose shall apply for a permit to park said trailer, and the City may at itís discretion, issue a permit to said applicant. The permit for the privilege to park one trailer per spot per year, shall be $10.00. Only one permit shall be issued per applicant unless the City deems sufficient spots are available to issue more than one permit per applicant. Each applicant shall be subject to the following rules and regulations, and such other regulations that the City Administrator shall administratively promulgate from time to time:

a. Trailers must be temporarily moved (for mowing and clean up purposes) by the permittee to the adjoining gravel location at least once per week, as per a schedule set forth by the Lanesboro Park Superintendent.

b. Permits may be revoked immediately without notice for an action by permittee that interferes with or are contrary to the interests of the City of Lanesboro, such as but not limited: canoes, trailer, tubes or other items being left on the ground rather than properly stored on the trailer; parking so as to interfere with access to the City brush dump; or permitting the permitted location to be unsightly or refuse strewn.

c. Parking of the trailer shall be at the permitted parking spots only and no parking of trailers shall be allowed in the DNR/City of Lanesboro parking lot, or upon any other public land.

d. These shall be at-will permits, meaning the City may revoke a permit at any time for any or no reason upon 5 days notice. Revocation of a license that is not for cause will result in a prorata refund fee to the applicant.

e. The City will not insure and will not be liable for any damage or loss to trailers or any other property kept at any location permitted hereunder.
