An Ordinance Regulating the use of Skates, Skateboards, and Scooters on Public Property in the City of Lanesboro

Whereas, The City of Lanesboro is concerned about the safety of individuals, and the protection of property as it relates to the operation of skates, skateboards and scooters on public property in the City of Lanesboro; and

Whereas, there is available or will be available, for users of skates and skateboards, the State of Minnesota Root River State Trail and the Lanesboro Skate Park; and

Whereas, the City of Lanesboro believes that the regulation of the use of skateboards, skates and scooters on public property, apart from rules to be established or established for the skate-park and Root River Recreation Trail, is in the publicís best interests;

Now therefore, The City of Lanesboro does ordain:

(a) Definitions. For the purpose of this section, the following terms shall have the meanings described herein:

Skate: Means a manufactured or assembled device consisting of a frame or shoe having clamps or straps or both for fastening onto a foot, with wheels or tracks on the bottom side of the device, which the user uses to skate or propel himself or herself along a surface.

Skateboard: A wheeled device designed to propel a transport a rider, which device is not otherwise secured to a riders feet or shoes.

Scooter: Any motorized or non-motorized device designed to propel a standing operator.

(b) Skate usage and skateboard and scooter riding prohibited. No person shall skate or ride a skateboard or scooter on any public street, or on a sidewalk located in the Lanesboro downtown commercial district, or on any public parking lot, or in any public or private parking structure in the City of Lanesboro, except in the Lanesboro Skate-park, or to the extent allowed by the DNR, upon the Root River State Trail.

(c) Enforcement. Any person committing a first offense violation of the provisions of this ordinance shall be guilty of a petty misdemeanor punishable by a $25.00 fine. Any person committing a second offense violation of the provisions of this ordinance shall be guilty of a petty misdemeanor punishable by a $50.00 fine. Any person committing a third or subsequent offense violation of the provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction for a violation hereof shall be deemed to have committed a public nuisance and shall be subject to punishment of a $1,000.00 fine or 90 days in jail or both. Moreover, said third violation shall result in that violator being barred from admittance to the Lanesboro Skate-park.
