My heart goes out to the Canton family being victimized by Fillmore County Zoning. It is very discouraging to know that rights which have been purchased by patriotic blood, guaranteed in the Constitution, and affirmed in numerous court cases are still being trampled by those who wish to control the property and lives of others. These types of central control measures didn't work in the Soviet Union and they won't work here. Individual property owners are unquestionably best qualified to make nearly all decisions now being affected by zoning. Counties set themselves an impossible task by attempting to micro manage every building decision. No one could do a good job of this and, believe me, they are not. I would sympathize with them but for the fact that I know from personal experience that some of these officials will lie, cheat, and steal and afterward proclaim their trustworthiness.

If courts refuse to defend the Constitution which they are sworn to uphold, the situation can play out in several different ways. First, freedoms might continue to be whittled away and the republic will continue lurching toward socialism. Second, some smart lawyer will get all those who have suffered loss as a result of zoning laws to join together in a class action lawsuit. This might well bankrupt every county in the nation but you can bet that the guilty officials who enacted the laws will go scot-free and Joe Taxpayer will be holding the bag as usual. As bad as this sounds it might be preferable to putting it off because somewhere along the line, zoning is going to push the wrong individual past his "snapping point" and these same power hungry officials will be wringing their bloody hands and pretending not to understand "why such a terrible thing has happened".

The only good way for zoning to proceed is to "BACK OFF." They should properly engage themselves with giving advice when asked and refereeing the very few disputes which would occur between individuals being allowed to use their own property as they see fit.
