Letter about Preston City Council

I am writing after my latest disappointing visit with the Preston City Council.

I was once again told that the Council was going to finally make a motion and vote on vacating the West portion of Mill Street so I could continue developing my Miniature Golf Course.

Instead of receiving action I was once again embarrassed and humiliated in front of a standing room only crowd as the Council popped up with two more flimsy excuses to postpone taking action on my June 5, 2000 request to vacate a piece of grass that I have been mowing since I purchased the property in May of 1986.

What is up with Mill Street? From the beginning City Attorney Joerg and the Council were extremely defensive in response to my request for Preston to vacate this portion of Mill Street.

Was this because the width of the Street had been changed from its platted 66’ width to a 60’ width with no public hearings or Council action to change the Street? And if so who would benefit from this 6’ portion of the Street?

Is it because the City took my property for the Trout Run Trail without paying me a penny for it even though David Joerg was quoted in the paper saying “everyone will get paid for their property?”

Is it because the City has been trying to get my property for the “Green Zone” for many years and they feel that if they create enough obstacles I will give up and give in to the ongoing discrimination I have experienced from the City of Preston?

I did some research in preparing for the last few rounds of meetings with the Council. I had Sheila Marzolf pull out minutes from other Streets, Alleys, and property that the City has had to vacate or sell to various individuals, or companies.

Birch Street is a blacktop road complete with curbing. I have a copy of the March 31, 2000 letter from LuVerne & Carol Soland stating that Birch Street needs to be closed to be able to resell the house at Lot 4, Block 4 of the Columbian Addition, City of Preston. April 17, 2000 16’ x 120’ of Birch Street was vacated after a motion by Gartner. Birch Street was done in 17 days. Was this because the instrument recorded as 310255 was Drafted by David A. Joerg, P.A.?

When it comes to Mill Street why would Gartner make statements like “if he meets all the conditio .....
