PRESTON - Timothy James Kuss, 41, of Rushford, was sentenced in Fillmore County District Court on Monday, January 14, 2008, to 10 years probation after pleading guilty to burglary. All other charges were dismissed as part of a plea agreement.
Kuss admitted to entering another person's house without their permission and using their computer to explore child pornography sites on the internet. This occurred in April 2007 in Rushford.
Judge Robert Benson sentenced Kuss to 18 months in prison, but stayed execution of sentencing for 10 years. Benson ordered Kuss to serve 90 days in jail, with credit given for 5 days served. In addition, Kuss was fined $1000 and ordered to register as a sexual offender. As part of the terms of probation, Kuss cannot go to places where children congregate, nor have contact with children other than his own without permission from his probation officer. He was also ordered to not use the internet.
Kristin Kathleen Sheldon, 20, of Spring Valley, was sentenced in District Court on January 14, 2008, to five years probation, ordered to serve 30 days in jail and fined $1000 after pleading guilty to driving while under the influence of a controlled substance - methamphetamine. She was given credit for two days served in jail. All other charges were dismissed as part of a plea agreement.
Sheldon admitted to possessing methamphetamine and marijuana after law enforcement found the items in her vehicle after she was pulled over for a traffic stop on February 21, 2007.
Judge Robert Benson stayed adjudication of sentencing for five years. As part of the drug sentencing, if Sheldon is law-abiding, after five years the felony charge would be cleared from her record.
Scott Christopher Dobbelaere, 26, of Rochester, was sentenced in District Court on January 14, 2008, to 68 months in prison after pleading guilty to possession of a controlled substance - methamphetamine. All other charges were dismissed as part of a plea agreement.
Dobbelaere admitted to possessing more than 25 grams of methamphetamine after being stopped by law enforcement in Chatfield on November 4, 2006. The arrest violated Dobbelaere's probation on narcotics charges in Olmsted County.
Judge Robert Benson ordered that Dobbelaere's sentence be served concurrently with his sentencing from Olmsted County.
