Brian Keith Rathbun, a 44-year old white male from Kasson, Minnesota, appeared before Judge Robert Benson on January 5, 2010, facing four counts of drug controlled substance crime, one count of receiving stolen property, one count of driving after revocation and one count of possession of prohibited drug paraphernalia. If convicted on all seven counts, the defendant could face a maximum penalty of 105 years in prison plus 90 days in county jail and/or fines totaling up to over $260,000,000.

On or about January 4, 2010, Fillmore County Sheriff's Deputy Investigator Dave Dyke was contacted by Chatfield Police Officer Aaron Miliander, who had arrested the defendant for a traffic violation. He had been called to a rural Chatfield home in Fillmore County when the owner found a car parked in his driveway with Rathbun sleeping inside the vehicle. Unable to wake him up, the owner called the sheriff's office. Officer Miliander responded to the call and was able to awaken Rathbun. At this time, he discovered the defendant was driving a vehicle after revocation of his license, and he also found $10,000 in cash as well. The defendant allegedly is a known user of methamphetamine and the large amount of cash in the car was enough to call in a narcotics detection canine to do a search of the vehicle. Lt. Holten of the Austin Police Department and his canine partner met with Dyke and Miliander at the Chatfield impound lot. A canine search alerted authorities to something in the vehicle, so after obtaining a search warrant, methamphetamine weighing 23.3 grams with packaging and also glass pipes which tested positive for meth were found.

It was also during this search that authorities discovered several wooden tokens for free drinks at the Windmill Bar in Dexter. Upon further investigation authorities found out that this same bar had been broken into over the past weekend and several wooden coins were among the items missing from the bar. At this point, Mower County Deputy Detective Juenger was called on the scene for this part of the investigation and was able to identify several items as those taken from the bar located in Mower County. Estimated value of stolen items was about $1,000.

The defendant is being held in the Fillmore County Jail. Judge Benson set conditional bail at $75,000 and unconditional bail at $300,000. Rathbun's next court appearance is scheduled for January 21, 2010.
