Quiet night at Planning Commission

Both the Fillmore County Planning Commission and the Board of Adjustment met last Thursday evening for their regular monthly review of variances and planning issues.

The Board of Adjustment session was first, and was conducted without controversy to a nearly empty room. Three variances were granted, all for setback adjustments. The first two were for additions on existing buildings that were within 100 feet of the centerline of the road.

The third request, from David Schmidt, was to split off an existing farm home, farm buildings and 20 acres for his son. The countys Zoning Administrator denied the split because the resulting homestead would be less than 40 acres and therefore no longer considered a farm under the countys current zoning ordinance.

Under its new classification as a non-farm home, the homestead would not meet the 1000-foot setback required for non-farm homes from an existing feedlot. The nearby feedlot belongs to the same family, so a variance was requested to allow the new non-farm home (that was a farm home until this split) to be 600 feet from the feedlot.

If this sounds confusing, thats because it is. Everyone on the Board of Adjustment seemed in agreement that the variance should be granted to allow the split so that Schmidts son could own the farm home with 20 acres. If Schmidt had chosen to sell the homestead with 40 acres, as required in the ordinance for farm designation, then a variance would not be necessary.

Planning Commission


There was little on the Planning Commission agenda to bring out a crowd, either. The only Conditional Use Permit on the agenda was for Sumner Township to construct a new facility. The permit was granted with little discussion.

The only other agenda item that was discussed was the proposed changes for the Agriculture District. With both the Zoning Administrator and the Planning Commission Chairman absent from the meeting, the dialog seemed to degenerate into boastful statements from an elected official who is dissatisfied with the zoning ordinance.

Commissioner Bakke informed the members of the planning commission that he intends to rid the zoning ordinance of confusing rules such as the farm/non-farm designations and the 40-acre definition of a farm.
