Planning Commission turns down subdivisionBy Mike McGrathMonday, October 29, 2001

At its monthly meeting last Thursday, the Fillmore County Planning Commission failed to recommend approval of a proposed five-lot subdivision on 40 acres in Fillmore Township.

The application for the subdivision was submitted by Rebecca Barr, but failed to get a motion for approval from the commission because of road access concerns. According to the county attorney, Matt Opat, the application can still go to the county commissioners for consideration.

Planning Commission Chairman, Mike Tuohy, opened the public hearing on the subdivision request and received a barrage of comments from neighboring landowners who were, for the most part, opposed to the subdivision. Most of the comments reflected concerns that five homes on 40 acres were too many homes for the rural area.

"We oppose that many houses," said Mrs. Stackhouse, an adjoining landowner.

The site of the proposed subdivision is on a sharp curve on that part of County Route 8 in Fillmore Township that is still a gravel road. The plan proposed separate driveways for each lot that would all open onto the gravel road. This is where the planning commission had a problem.

Commissioner Duane Bakke was first to point out the access concerns, inquiring how many accesses are allowed for a subdivision under the current ordinance. According to Zoning Administrator, Norm Craig, other subdivisions in the county have multiple accesses.

After listening to the comments from the public, and discussing what impact this subdivision might have on the new proposed zoning changes with respect to setting a precedent, Chairman Tuohy called for a motion to approve the subdivision. Silence reigned.

Finally, planning commission member Jim Keune spoke, "There is a public safety issue with the road access here."

"If we have no motion then the request dies for lack of a motion," explained Tuohy.

At this point, Opat advised the commission that the matter could still go before the commissioners for approval with or without the recommendation of the Planning Commission.

Shoreland setbacks

At the request of Norm Craig, Hydrologist Bob Bezek of the DNR made a presentation to the planning commission on the states setback requirements for buildings in the shoreland district.
