The Fillmore County Planning Commission held its July meeting on the heels of an emotionally charged Board of Adjustment meeting on July 26. And similar to the Board of Adjustment meeting, the planning commission faced a barrage of public comment when it considered Conditional Use Permits (CUP) for two new hog confinement units.

The air was already thick with the emotions leftover from the Board of Adjustment meeting when Chairman Mike Tuohy called the planning commission to order.

At the outset, County Commissioner Duane Bakke, who also sits on the planning commission, made an unsuccessful attempt to amend the minutes of the previous planning commission meeting to show that the planning commission had not placed conditions on two Amish sawmills.

The County Board added the waste pile burning conditions to the CUP when they approved them, but they had not been listed on the CUP when they were presented to the County Board for approval. However, they mysteriously appeared on the minutes of the planning commission meeting and Bakke wanted them removed.

No one on the planning commission could recall that the conditions had been added at their level, and even Chairman Tuohy acknowledged that the applicants had clean sawmills, "so we were going to let them go" without conditions.

Despite this comment, and even with Commissioner Marc Prestby, who was in the audience, claiming that Zoning Administrator Norm Craig had not presented a comment letter to the planning commission with regards to a complaint about one of the sawmills, no one was willing to second Bakke’s motion.


"Well then, Norm, I request that you get a tape recorder here for the minutes," demanded Bakke.

County Attorney, Matt Opat, reminded the planning commission that the entire group would need to approve the use of a tape recorder. No action was taken on the tape recorder.
"Do I worry about my water?"

The first public hearing on the planning commission’s agenda was on the application of Eric Scheevel to construct a hog confinement feedlot in section 28 of Carimona Township.

The County Feedlot Officer, Mike Frauenkron, walked the commission through Scheevel’s application, noting that all was in order and compliance.

However, this didn’t seem to satisfy John Ristau, a neighbor of Scheevel.
