Roger Paul Clark appeared in District Court before Judge Robert R. Benson on Monday, September 20, 2010, for sentencing. Representing Mr. Clark was attorney Frederick S. Suhler, Jr.; Attorney for the State was Mr. Brett Corson.
Based on the defendant's plea of guilty to the felony charge of burglary in the third degree, count two, the Court found Mr. Clark guilty as charged and dismissed all remaining charges in the complaint. The Court further ordered the defendant be committed to the Commissioner of Corrections for a period of 18 months with at least two-thirds of that time to be served in prison and a maximum of one-third of this time on supervised release. Execution of commitment was stayed for five years, and the defendant was placed on supervised probation to Court Services for those five years. The Court further ordered that the defendant serve 120 days in the Fillmore County Jail with credit for the 68 days already served. In addition, the Court ordered the defendant to pay restitution in the amount of $2,544.80 payable on a schedule set by his probation officer. Defendant was also ordered to pay fines and fees totaling $1,490.
