On Friday, August 12, 2011, two people appeared before Judge Robert Benson at the Fillmore County Courthouse. Both Juan Canales Lumbreras, (a.k.a. Juan Francisco Canales), 19, and Maylcol Amaya Lopez (a.k.a. Israel Garcia), 19, of Rochester were charged with two counts of Criminal Sexual Conduct with use of force or coercion, which holds a maximum penalty of 30 years in prison, $40,000, or both. They were also charged with Criminal Sexual Conduct, victim mentally impaired/helpless, which has a maximum penalty of 25 years in prison, $30,000, or both.
Brett Corson was the prosecuting attorney for both defendants. Richard Smith was the defense attorney for Lopez, and Frederick Suhler the defense attorney for Lumbreras.
On August 2, 2011, a 17-year-old girl claimed the two men sexually assaulted her at the canoe launch on County Rd. 2. She said earlier in the evening Juan Canales Lumbreras and a friend she didn't know showed up at her house. They went to the canoe launch area and began drinking. The defendant said the two men forced her to drink something they wouldn't drink, and afterward, she couldn't feel anything or move. The two men then allegedly assaulted her. Lumbreras and Lopez both denied giving her anything except alcohol. Both remain in custody with $20,000 conditional bail and $40,000 unconditional. Their next appearance is September 12 for an omnibus hearing.
