Decorah doctor makes court appearance

PRESTON - Dr. David John Heine, 38, of Decorah, Iowa, appeared in Fillmore County District Court on Monday, July 16 charged with two felony counts of burglary, which took place at two area high schools. In addition, Heine also faces misdemeanor trespassing and theft charges.

Dr. Heine is on leave as chief medical officer of Winneshiek Medical Center in Decorah.

According to court records, it is alleged that in May 2007, Heine entered the Fillmore Central High School and Mabel-Canton High School boys' locker rooms and took several items of clothing and other personal items.

Heine's attorney, William Mauzy, requested an Omnibus Hearing. Mauzy said he expects to challenge the probable cause for the types of charges being filed as well as evidence. Judge Benson set October 1, 2007 at 2:00 p.m.

Judge Benson released Heine on his own recognizance with conditions. The state had requested that conditional bail be set at $1000 and unconditional bail at $5000. Heine's attorney had argued that the doctor had close ties to this community.

Following court, Heine went through in-processing at the Fillmore County Jail.
