Felony Charges

A Wisconsin man was charged in Fillmore County District Court with felony theft for allegedly stealing from two area businessmen this past summer.

According to court records, Charles Jason Hutter, 35, of Beaver Dam, WI, allegedly stole a cash box containing $1400 from Countryside Furniture, a rural Harmony business on or around July 4, 2008. He is also charged with stealing the wallet, containing $450, from another Fillmore County businessman on August 26, 2008.

Hutter was arrested in Sauk County, Wisconsin for the robbery of a convenience store. He was also wanted for string of thefts in Columbia, Sauk and Juneau counties in Wisconsin.

Hutter was identified in a photo lineup by the two Fillmore County men.

Judge Robert Benson released Hutter on his own recognizance with conditions, pending his next court appearance on November 24, 2008.

Felony Sentencing

• Quentin Richard Miland, 18, of Spring Valley, was sentenced to five years probation after pleading guilty in District Court on November 17 to two felony counts of assault. All other charges were dismissed as part of a plea agreement.

Miland admitted in court that on April 18, 2008 he punched a 15 year old minor in the face during an altercation. The boy suffered a broken bone in his face.

Judge Robert Benson stayed adjudication of guilt on each charge for five years and ordered Miland to pay $1000 fine, serve 30 days in jail, participate in an anger-management course and write a letter of apology to the victim. He must also pay $746.30 restitution to the victim and $5310 to Blue Cross for reimbursement of medical costs.

• Henry James Derks, 49, of Spring Valley was sentenced to seven years probation after pleading guilty in District Court on November 17, to driving while under the influence.

Derks admitted in court that he was driving while under the influence when he was stopped at the Kwik Trip in Spring Valley on April 5, 2008, by a law enforcement officer.

Judge Robert Benson sentenced Derks to 42 months in prison, but stayed execution of sentencing for seven years on the condition that he is law abiding.

Benson ordered Derks to pay a $2500 fine and serve 180 days in jail. Derks must comply with out-patient treatment, not consume alcohol or drugs, and submit to random testing.
