Fillmore County District Court - July 26, 2010

On Monday, July 19, 2010, Charles David Sackett, a 26-year old white male from Winona, appeared before Judge Robert R. Benson in District Court facing two counts involving check forgery and offering a forged check. If convicted, the maximum sentence could be 10 years in prison, fines totaling as much as $20,000 or both. Representing Mr. Sackett in court was attorney Frederick S. Suhler. Prosecuting attorney was Brett Corson.

On May 9, 2009, Rushford Police Officer Steven Garrett was contacted by Kathy Zacher, city clerk, that two checks had been written on a closed account at the Rushford Municipal Liquor store. Two more checks were turned over to Officer Garrett written out to Rushford Foods, Inc., by what appeared to be the same person on the same closed account. Checks from the same person and account were also passed at Pam's Corner.

Upon a thorough investigation and watching a video taken at the liquor store, Officer Garrett was able to determine that the person passing these forged checks, in the name of his step-brother, was the defendant, Charles Sackett. Since Mr. Sackett was on probation at the time, Officer Garrett also questioned the probation officer in charge, and the defendant was taken into custody and is currently confined to the Minnesota Correctional Facility in Faribault. Officer Garrett questioned the defendant, who claims he passed the checks with the step-brother's permission and said the step-brother signed the checks and asked him to pick up the items for him because he had a sprained ankle at the time. However, the step-brother denies giving him permission to write out checks in his name and denied having a sprained ankle.

Judge Benson set unconditional bail at $10,000 and Sackett was returned to the correctional facility in Faribault to await his next appearance in District Court, which is set for August 9, 2010.
