Shane Roger Marx, a 33-year old male from Rochester, appeared before Judge Robert Benson on May 3, 2010, facing one count of theft. If convicted, the defendant could face up to 10 years in prison, a $20,000 fine or both. Mr. Marx has been charged with allegedly swindling $6,400 from a former client who had hired him to do some tree removal work for him. Although that job had been paid for, another check was issued to the defendant in the form of a "loan" to purchase tree service equipment. The money borrowed has not been repaid, and the family is concerned that the person lending the money was taken advantage of by the defendant. The defendant was released on his own recognizance and unconditional bail was set at $20,000. His next court appearance is scheduled for June 1, 2010.

On May 3, 2010, Daniel Lee Dornack, Jr., a 29-year old male from Preston, appeared before Judge Robert Benson facing four counts involving terroristic threats, domestic assault, assault in the fifth degree and disorderly condict. If convicted, the defendant could face a maximum of five years in prison, 270 days in jail, and up to $13,000 in fines.

On or about March 31, 2010, Mr. Dornack allegedly made threats to kill another individual and her children. Fillmore County dispatch received a call regarding this domestic incident and Officer Blaise Sass and Police Chief Matt Schultz responded to the call. Deputy Derek Fuglestad was also dispatched to the scene. The defendant was outside at the time and said he had been allegedly struck in the head with a crow bar by the victim, who was inside the house. Upon questioning the female victim, who denied hitting him, she confirmed that there had been an altercation between the two that resulted when she flushed a meth pipe down the toilet. She admitted that drugs and alcohol were involved in the incident and it was obvious that she had been physically assaulted in the process. Mr. Dornack was released on his own recognizance and unconditional bail was set at $10,000. His next court appearance is slated for June 21, 2010.

Nathan Robert Winslow, a 18-year old male from Wykoff, appeared before Judge Robert Benson on May 3, 2010, facing four counts involving burglary in the third and fourth degree, theft and damage to property. If convicted on all four counts, the defendant could face a maximum of six years in prison, 180 days in county jail, and fines amounting to $15,000.
