On Monday, November 16, 2009, Ryan Spencer Schultz, a 20-year old male from Lanesboro, appeared before Judge Robert Benson in District Court facing one count of criminal sexual conduct in the third degree. If convicted, the maximum penalty is 15 years in prison, $30,000 in fines or both. On or about November 13, 2007, the defendant allegedly had a sexual encounter with a 15-year old girl at her home in Rushford. The girl's father called the authorities regarding the incident, but the girl would not cooperate with the police. Rushford Police Chief Sam Stensgard was notified and Stensgard then met with the defendant who admitted to him that he had engaged in a sexual relationship with the girl. He also admitted that he knew she was 15 at the time of the incident.

Judge Benson set bail at $10,000 conditional and $30,000 unconditional bail. His next court appearance is scheduled for November 30, 2009.

Trevor Daniel Schweitzer appeared before Judge Robert Benson on November 16, 2009, for sentencing. Lee M. Novotny, assistant Fillmore County attorney, appeared on behalf of the state. Schweitzer waived assistance of legal counsel and entered a plea of guilty on September 28, 2009, to count one in the charge of controlled substance crime in the fifth degree (possession of cocaine), which is a felony. All remaining counts were dismissed by the court pursuant to plea negotiations between the defendant and the state. The court ruled the defendant be committed to the Commissioner of Corrections for a period of 12 months and one day and ordered the adjudication of guilt be stayed for five years. The court further ordered that the defendant serve 30 days in the Fillmore County Jail with credit for 13 days previously served, and that he then be placed on supervised probation and pay fines amounting to $1,015.
