On October 12, 2009, Nathan Marc Johnson, a 34-year old Spring Valley man, appeared before Judge Robert R. Benson facing three counts of domestic assault, one by strangulation, and one count of fourth degree criminal damage to property. If convicted of all four counts, Johnson could face a maximum penalty of four and a half years in prison with fines totaling up to $10,000.

On October 8, 2009, at approximately 7:35 p.m. Fillmore County Deputy Don Kullot responded to a call from a nine-year old girl who said her mother was being strangled by a man. When Kullot arrived at the Spring Valley home of the alleged crime, he was met by the defendant and the caller's mother. The defendant told Deputy Kullot that he and the alleged victim got into an argument and when she would not get off the computer to talk to him, he grabbed her laptop and threw it into the large flat-screen television, smashing it to pieces. Johnson denied touching her and said the kids were downstairs and didn't see anything.

State trooper Bruce Spurgeon arrived on the scene to assist, and according to his report, the victim told him Johnson grabbed her by the throat, and the force of the impact caused her to fall back onto the floor. The nine-year old daughter told him she was downstairs at the time of the incident but could hear something falling upstairs and Johnson shouting at her mother. She said it was difficult for her mother to talk, but she managed to tell her to go to the neighbor's house and call the police.

The victim indicated she did not feel safe around Johnson and was issued an Order For Protection. Johnson has had a prior conviction for domestic abuse for violating an OFP going back to June of 2005.

Johnson is out of jail on $1,000 conditional bail and $10,000 unconditional bail. His next court appearance is scheduled for October 26, 2009.

On Monday, October 12, 2009, Collin Daniel Pontillo, a 20-year old Preston man, appeared before Judge Robert R. Benson facing one count of burglary in the third degree which carries a maximum penalty of five years in prison, a $10,000 fine or both; one count of property theft that carries a maximum penalty of $1000, 90 days in jail or both; and one count of receiving stolen property which also carries a maximum penalty of 90 days in jail, a $1,000 fine or both.
