Livingood appeal denied as board upholds zoning administrator’s decision

If you want to see the “firing line” in county government, where tough decisions are made in front of an emotional, standing room only crowd, then the monthly Fillmore County Board of Adjustment meeting is the place to be.

Members Gene Horseman, Gordon Gullickson and Chris Sukalski were in the “hot seat” on Thursday night, acting on a number of variance requests.

Probably the most emotional item on the agenda, however, was the appeal by Robert Livingood of Fountain Township to have the Board of Adjustment overturn a decision by the Zoning Administrator, Norm Craig.

Craig, as you may recall, had informed the Livingoods that they must remove a mobile home on their property that was not in compliance with the zoning ordinance.

The mobile home had recently been moved onto a site in Section 24 of Fountain Township, along Highway 52, to replace a previous mobile home. But when Livingood sold off most of his farm, and the zoning ordinance changed to limit non-farm homes, the mobile home became a non-conforming use.

This matter was originally discussed at the July meeting of the Board of Adjustment, but was tabled until Thursday.

County Attorney Matt Opat, when asked to clarify the role of the Board of Adjustment in this matter, said that this case was not a variance.

“This is not about hardship.” Opat said. “This is an appeal of a zoning administrator’s decision. You must decide if he was correct or not correct in making his decision. ”

Several people spoke in support of the Livingoods being allowed to keep the trailer on the site.

Jim O’Connor, of rural Preston, said that if a trailer has been on the site for 25 to 30 years, and the law has been changed only in the last 10 years, then the trailer should be grandfathered in.

But the board of adjustment, voted unanimously to support Craig’s decision, denying the Livingood’s appeal.

Board member Chris Sukalski seemed to speak for all three members when she said that “while this might be a fine use for that land, I am not going to second guess Norm’s (Craig) interpretation.”

It is expected that the zoning office will send a letter to the Livingoods giving them a set period of time to remove the trailer. Non-compliance could result in legal action being brought by the county attorney’s .....
