Commissioners seek answers for subdivision questions

By Mike McGrathThe subdivision proposed by Rebecca Barr in Fillmore Township was again on the commissioners’ agenda last week. This time the county board dealt with the project head-on in their chambers, listening to comments from the zoning administrator, the project’s owners, and neighbors who are in opposition to the five-lot subdivision.

Originally, the Fillmore County Planning Commission chose not to recommend the project for approval and it therefore passed on to the laps of the commissioners. On November 13, the board looked at the site with the zoning administrator, the assistant county engineer, and several township officials, but took no action.

Last week, the board waded through a muck of unanswered questions trying to determine what actions need to happen for the subdivision to be approved. The issues that were discussed included road access for the proposed lots, bluff setback requirements, and soil borings for potential drainfield sites.

The subdivision site is located on a gravel section of County Road #8, north of Good Earth Village, that is scheduled to be reworked. Commissioner Harry Root took a leading role in the discussion, trying to ascertain if anyone had really determined where the new right-of-way would fall. He also inquired of Norm Craig, the county’s zoning administrator, if there was a bluff on the site.

"The surveyor says there is a bluff," responded Craig as he pointed to the preliminary plat.

"Have there been soil borings done for the drainfields?" asked Root.

Craig indicated that, because the drainfield sites were shown on the plat, there must have been borings done.

"Do you have a record of the soil borings?" inquired Commissioner Randy Dahl. "I want to see the soil borings."

The applicant, Ms. Barr, seemed to indicate that the soil borings had been done, but said she would check with her surveyor. Since the county does not require that soil borings be made before drainfield sites can be drawn on a preliminary subdivision plat, it was unclear why Craig indicated that they must have been done.

"Well, who determines what is a bluff?" continued Commissioner Root.

"The surveyor determines that," responded Craig.

The discussion shifted to the road access and right-of-way issues and the applicant made it quite clear to the board that she was willing to make adjustments as needed.
