Russell Lynn Foster, 54, Grand Meadow, Minn.; 11/20/2021, DWI – Operate Motor Vehicle Under Influence of Alcohol, Fine $700 (stay $400), Total Fees $415.  Local Confinement – 90 days (stay 87 days for one year).  Credit for time served: three days.  Unsupervised probation for one year – Conditions (1/28/2022): Remain law-abiding, No same or similar, No driving without valid driver’s license and insurance.

Sydney Rae Minegar, 31, La Crosse, Wis.; 12/10/2021, DWI – Operate Motor Vehicle – Alcohol Concentration 0.08 Within Two Hours, Fine $300, Total Fees $400.  Local Confinement – 90 days (stay 90 days for one year).  Unsupervised probation for one year – Conditions (2/7/2022): Complete booking – report to Houston County Sheriff’s office within 10 days for booking, No same or similar, Follow all instructions of probation – abide by any and all rules and reasonable directives of the supervising agent.

Kelsey Kaye Pendergrass, 30, Elk River, Minn.; 11/28/2021, DWI – Operate Motor Vehicle – Alcohol Concentration 0.08 Within Two Hours, Total Fees $150.  Local Confinement – 364 days (stay 274 days for six years).  Credit for time served: one day.  If defendant complies with staggered sentencing and if defendant files a motion, three 30-day jail segments may be deferred.  If defendant is convicted of another DWI, then all jail may be executed.  Supervised probation for six years – Conditions (2/3/2022): Sign Probation Agreement – as directed by agent – report to Department of Corrections within 24 hours of this hearing (February 3) or upon release from custody – cooperate with interstate transfer and rules regarding out of state travel (if applicable) – follow general and standard conditions of probation, Follow all conditions set forth in the Probation Agreement, Remain law-abiding and be of good behavior, No controlled substance use – abstain from the use of illegal substances, Follow all rules of travel, Follow directives of supervising agent, Follow recommendations of evaluation – abstain from substances as recommended by current treatment or evaluations, Sign releases of information as directed.

Richard Maria Van Lin, 55, La Crescent, Minn.; 10/16/2021, 4th Degree Driving While Under the Influence of Alcohol, Fine $300, Total Fees $400.  Local Confinement – 90 days (stay 88 days for one year).  Credit for time served: two days.  Unsupervised probation for one year – Conditions (2/4/2022): Complete Chemical Assessment (completed) – defendant provided correspondence regarding the recommendations to the prosecutor – no recommendations resulted from the assessment, Alcohol monitor (completed) – defendant has already completed 30 days of alcohol monitoring on the SCRAM bracelet, Remain law-abiding and be of good behavior, No same or similar, Defendant will report any violations or new offenses to the prosecuting attorney within three business days.

Mark Allen Peitzmeier, 41, Mabel, Minn.; 9/18/2021, Careless Driving – Operate Any Vehicle Carelessly on Street or Highway, Fine $400, Total Fees $575.  Local Confinement – 90 days (stay 90 days for one year).  Supervised probation for one year – Conditions (2/4/2022): Sign releases of information as directed, Sign Probation Agreement – as directed by agent by February 18 – report to D.O.C. immediately after this hearing or upon release from custody – cooperate with interstate transfer and rules regarding out of state travel (if applicable) – follow general and standard conditions of probation, Follow all instructions of probation – abide by any and all rules and reasonable directives of the supervising agent, Tell probation officer within 72 hours if change address, employment, or telephone number, Contact probation officer as directed, Remain law-abiding and be of good behavior, Attend MADD Impact Panel (completed prior to February 4 sentencing hearing), Complete Alcohol Assessment – as directed by agent within/before March 21 – sign releases and follow all recommendations.

Question: Hello, maybe you can clear this up for me, what is the definition of stop? I think a slight pause is good enough. I look at it as I am stopping, but everything is clear so I can proceed.

Answer: To answer your question, it is called a “stop sign” not a “stopping sign.”

According to Minnesota State Statute, the definition of “stop” means complete cessation from movement.

“Stopping” means any halting even momentarily of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal.

Look twice at intersections when turning and changing lanes. Drive smart and pay attention.

Please remember that you can avoid a crash — and a ticket — if you simply buckle up, drive at safe speeds, pay attention and always drive sober.  Help us drive Minnesota Toward Zero Deaths.
